After 10/15/2008, the IRS stopped considering 2007 tax returns for the stimulus.

Any remaining money was distributed based on the 2008 return, which you didn't file, but could. If you are NOT a dependent, go ahead and file, while $5000 wouldn't cause you to owe, it would be enough income to qualify for $300 of "rebate recovery credit."

As you discovered, addresses are updated when new tax returns come in. An old return with an old address will update to that address.(I do know people who have moved back to old addresses--even apartments!) This isn't the IRS/State's fault.

As for the form 3911, the IRS will trace the refund. If it wasn't cashed, they will reissue it. If it was cashed, they will send you a copy with forms to fill out if you believe the signature was forged.

The from the state saying that the refund was more than you were expecting and has already been cashed is more troubling. That would suggest the copy of the return you have isn't the one that was filed. Ask the state to give you a copy.

PS, if the money was stolen, why do you care what happens to the person who stole it? (Other than to hope they are sent to prison for a long time, of course.) Not wanting to get someone in trouble is often construed that you know who has the money....
