No. If part of that fee was for tax prep services or tax advice AND was billed separately as such, that part is deductible. The portion of the fee for the BK action is not tax deductible.

No. If he showed an amount on his bill separately that was for tax advice, it's possible although not likely that you might be able to deduct that portion.
Only the portion of legal fees that are related to taxes can be written off.
