Can they make u pay back unemployment?

I was laid off the end of August from a temp agency which i worked at for 9 months and started collecting unemployment.

3 weeks ago they asked me to come back and work another 8 week assignment. I agreed, but when I arrived they wanted me to work a TOTALLY different job which required being on the phone all day. I explained to the temp agency that i cannot do phone work do to a medical problem, but i would be glad to take the position i was originally offered. They had me talk to the manager to hear more about the position, which again i was told phone work. So I went home to think about it & discuss with my doctor. I e-mailed the temp agency and told them I could not do the position and could supply medical documentation and asked to be placed in the position i was originally offered. I was told it was not necessary. I was then e-mailed and told not to return, the only position available was the one they had spoke to me about.

Well I filed for unemployment yesterday as normal, since I never actually worked and it went through. But a friend was telling me down the line they could come back and say I wasn't eligible, and could ask me to pay it back? But I'm not sure why I wouldn't be, I have medical documentation proving i cannot do that kind of work, & e-mails showing i was orignally offered one job and accepted.I did not quit & they never said they were firing me, they just told me not to return, which to me means being laid off again.

Any input?

Your friend like to pull wings off of butterfly's and legs off of flies. No truth - on your weekly card you may state that you did turn down employment based on your medical documentation. You may be called in to explain, and produce your medical documentation - because your former employer is aware that you are collecting insurance benefits, and may report that they offered you a job. Don't sweat it, you haven't lied or perjured yourself, as thousands have already.

I would not worry. But yes you could pay them back.

This is what temp agencies are best at, most Temp agencies like to play games with poeple.

You don't explain what kind of medical reason for not working on a phone, unless you have a hearing loss, but many companies have adaptors that will allow you to adjust the speakers to hear. You do not also state what your previous position was that you would have been willing to work again.

Granted in effect you have told the truth and you state you have a medical excuse stating you cannot do. But be prepared with all your documentation just in case. On most weekly claims you file, it also asks for any employers you interviewed with, talked to etc. Did you list this employer? If not and they find out, they could get suspicious and then go thu all your records to verify you have not left anything out.

And yes, they can go back later and request reimbursement, but hopefully this will not be an issue.

Well don't be worried.the job you rejected,you were not able to do that,that means you are back in the position as you were before this offer of phone.So there would be no objection in paying you the unemployment.And another thing,they can never ask you back the money they because the form you filled was the only thing they demanded for other thing the insurer has waived his rights.So you need not to worry.you are still unemployed I am sure for my answer.
