The court date is set for 12/30/09. I didn't know this was happening until I was looking through the court listings online and saw my name.
Wait a min....have you received summons? If not, call the court to let them know that you haven't received summons from them at all. They have to reschedule the court date if possible. If it is your debt that you owe them. The best thing to do is settling with them before going to court. Once you settled with them to make sure you get in writing before you pay to them. Just show up the court date to show that you have settled with that company then they will let you go. Good Luck!
To be taken to court and instead of just paying the $760.63 that you owe them you will be paying a bunch of extra interest, court fees, and any other fees they can slap on you.
You can also expect for this to be turned into the credit bureau as a bad debt and that they had to take you to court to get you to pay it.
This will stay with you for at least 7 years.
Getting a loan or another credit card it the future may be really hard.
You have to go to court at the time, date and place specified. Failure to appear automatically results in the plaintiff (CapOne) getting the judgment. Then they can garnish your wages, put a lien on your property, sometimes even repossess property.
BTW, the judgment won't be for $760.63. Add CapOne's lawyers' fees, court costs, interest, penalties, collection costs. Probably run you at least $1500 - 2000.
I'd get a lawyer. I know one in Chicago..on in Nashville.
Otherwise, I'd just pack up your clothes and maybe...head to Canada??
Well they are going to try to get a judgment against you so they can either garnish your wages or take any assets you may own. you will want to bring all of your other bills and income information.
how could you not know you owed his money?
