I traded a few gift cards with a lady online for a lot of make up....the giftcards were about $100 and the makeup was worth about $150
she got a tracking number with my package but I didn't with the gift cards, now she claims I didn't send them and is threatening to take me to court....could this happen? would she win?
At it's very worst...its a small claims issue, and more her word against yours. Once the cards leave your possession with a shipping number...it is now the sole responsibility of the postal service.
I would just send her back the product or find a way to pay her it sounds like a risky buisness trying to pay with non legal tender
but as long as you have some form of proof that you did pay with the cards an that you have proof of the cards there shouldnt be an issue
Tell her you will send her stuff back to her.
She has no proof you did not send the stuff. I don't know who would win but it is a case for small claims. But it costs that much money just to file.
Did you keep your receipt from the post office?
Sure, she can take you to court. It will be down to who the judge believes, if you have no receipt, AND no tracking.
Lesson learned. If you sent it UPS you'd have been insured automatically for up to $100 and had a tracking number. Always track your packages.
