What is the law regarding local taxes in PA about how an employer takes out the tax?

My husband works in one town, where the local tax rate is 2%, and we live where the tax rate is only 1%. i know for filing, that it goes by where you live, and we are always waiting on a big chunk of money that we usually don't get back until June/July (and we file in February). His employer says they have to take out the rate according to the town he works in...so they won't change it from 2% to 1%. But his employer has been wrong many times bafore about many things. Does anyone know the law on this?

The easiest thing to do is to call both of the townships (where he works and where you live) involved and ask them directly. Start with your own local township and attempt to enlist their aid in what to do/say to have it changed to your local jurisdiction.

PA is weird in that the law is different based on the locality you are in. Your employer may be correct, and you just have to pay in your locality and file for a refund from the other. Call the localities directly. If you are nice to them and ask politely for assistance, they may be able to give you the help and advice that you need.

If that does not work, go talk to a good accounting firm and ask them for their advice.

more than likely since this is a local, city tax, it probably does depend on the city the employer is in
