Can you cash a post dated check the day before after 1pm?

I'll be getting my paycheck on the 5th and its post dated for the 6th and really need the money on the 5th and I was wondering if I wait till 1pm to try and cash will it be considered the next day? oh its a bank of america check

The thing about checks - is when they are issued they are suppose to be issued free and clear.

The bank is not suppose to worry about the date on the check UNLESS
1- its after 90 days
or 2- the writer of the check has contacted the bank from which the check is being drawn on and described it with specificity (ie check number- and indicate that it is post-dated and that the amount should not be deducted from the account until the date of the check.)

Further, there are several banking regulations about when bank cashing the check can hold the money etc...ie foreign checks, suspicious checks.

Sorry for the legal jargon but the answer is yes- you should be able to cash the check on the date you receive it regardless of the date on the check.

In the US, you can cash a post dated check 5 seconds after it is written. Post dating is legally meaningless under US law. Outside the US, the rules may be different. MANY US banks have 'same day, all day' processing. That mean the cutoff time for a transaction to post the same day is whenever the bank closes.

Most banks will let you put the money in the bank after 2pm the day before but it will not actually be avalible to take out until the next day. I've learned this the hard way.

most banks will allow you to cash it, depends on there policy but it generally isn't a problem. Check cashing places take them as well.
