Which State has the worse worker's comp system?

Workman's comp is so confusing with every state having their own set of rules. Does your location make it easy or hard for you to through work comp?

It depends on what side your looking from. From a claimant's side Virginia might be considered a nightmare for claimants because the law states that you must have sustained a direct injury from work. This means if you broke your arm while carrying a heavy item this would be covered, but if you sustained carpel tunnel syndrome at work than it would be denied due to it not being a direct injury from work, meaning it took years to have carpel tunnel syndrome.

CA could be considered a nightmare for adjusters due to it's complex laws and regulations. Insurance companies are responsible for the first 14 days of treatment, so you would have to eat the cost of surgery even if you feel the claim is denied.

OR could be a nightmare to both people as it's complex. Different ways to calculate a persons average weekly wage, different rules on who can be the attending physicians and such, i.e. Doctors (MD, DO) are considered OK, chiropractors are limited as well as PA's and RN's.

Longshore has it's own sets of rules which benefits the claimant and insurance company equally, while Jones Act claims are typically a nightmare claims as it becomes more complex.

My location can be difficult to deal with but it's by case by case.

Location has no bearing on how easy/hard it is to get through it.
