I was recently put on unpaid leave, which I later found out is not allowed under my contract, I have been on leave for 3 weeks now and have been told the company is going into liquidation next friday and the liquidator is going to pass on RP1 forms onto me to claim redundancy pay from the government.
My question is... there is a question on the form asking if my employer owes me any unpaid wages, as I read on the direct gov website that I should of got full pay if unpaid lay offs were not allowed, can I claim 4 weeks unpaid wages on the form??
Thanks for your help!
Yes. You cannot be laid off without pay unless this is part of your contract and you have agreed to it. These are unpaid wages and you can claim for them.
